  1. Service numbers supplied by Koala - Koala service numbers are used for identification purposes. A user does NOT own the Koala number he or she picked or specified. The user pays Koala for the process of connecting a Koala number with relevant online services. The user does NOT pay for the number itself in anyway. Koala has the sole right in the use of the number and can assign the number to anyone or anything it chooses. Koala numbers are normally assigned on a first come first serve basis, however, preference is given to some parties at Koala 's discretion.  If you have requested Koala to transfer an existing number to our system, and while Koala makes no guarantee that it is possible, it MAY be possible to transfer that number elsewhere if you decide to leave us. Responsibility for that transfer is entirely yours.

  2.  Breach - If, in Koala 's opinion, you breach any of terms and conditions of this Agreement, we may suspend, terminate or limit your access to the Service and terminate this Agreement effective immediately. The termination of the Service shall not preclude Koala from exercising any other rights Koala may have against you under this Agreement.

These terms plus the terms of the chosen Service(s) constitute the entire Agreement between the Customer and Koala in relation to Service(s). Any condition, warranty, representation or other term which might otherwise be implied into or incorporated into these terms and conditions, or any collateral contract, whether by statute, common law or otherwise, is hereby excluded. Neither party shall have any remedy in respect of any untrue statement made to it upon which it relied in entering into this Agreement (unless such untrue statement was made fraudulently) and each party's only remedy shall be for breach of contract as provided in this Agreement.

  1. Termination fees

Termination of service on accounts under contract will be charged the monthly fee for the remainder of the contract period. E.g. If you have 8 months left on your 12 month contract on a $29.95 per month package you will be required to pay $29.95 x 8 which would be $239.60. This only applies IF you have a minimum contract period.
